INFORMATION NOTE ON OPERATIONAL COOKIES PURSUANT TO ART. 13 OF REGULATION (EU) 2016/679

Transparent information on the operational cookies of this website are provided below, in compliance with Directive 2009/136/EC and the relative provisions of the Regulatory Authority for Privacy ("Garante") measures no. 229/2014 and no. 231/2021.

Data Controller

Definition of cookies

Cookies are short fragments of text (letters and/or numbers) sent by the website and stored by your browser on the specific device you use (computer, tablet, smartphone) and contain information that can be reused during the same visit to the website, even days later. Cookies are stored based on the user’s preferences.

With the introduction of HTML5, several forms of local storage and similar technologies are available, such as web beacons, tracking pixels, and transparent GIFs, which can be used to collect information about the user’s behavior, choices, and use of services.

In the present document the term "cookie" refers to cookies and all similar technologies.

Types of cookies

Based on the characteristics and use of cookies it is possible to distinguish two macro-categories:

  • Technical or session cookies These cookies are crucial for the proper functioning of the website and are used to manage the login and access to confidential features of the website. The duration of cookies is strictly limited to the working session (once the browser is closed, they are deleted), except for longer-lasting cookies designed exclusively to recognize, for a limited period, the user’s computer/device with an alpha-numeric code generated with the first login session. Their deactivation affects the use of services accessible through the login. The public part of the website remains normally usable.

    The so-called "cookies analytics" are also included in this category, only if used in an aggregate form to collect and analyze traffic, and monitor performance and use of the website anonymously. Although these cookies do not identify the user, they do allow to detect whether the same user logs on at different times. They also allow to monitor the system and improve its performance and usability. These cookies can be deactivated without any loss of functionality.

    The use of these cookies is also permitted without the consent of the data subject.

  • Profiling and marketing cookies These are permanent cookies used to collect the user’spreferences, even without direct identification, and improve his/her browsing experience creating specific profiles, and to send advertising messages based on web browsing.

Pursuant to art. 122, para. 1 of Legislative Decree 196/03 ("Personal Data Protection Code"), profiling and marketing cookies may only be used if the user has given consent after being informed in a simplified manner, according to art. 13 of the Personal Data Protection Code and Regulation (EU) 2016/679.

Third-party cookies

When visiting a website, cookies may be received either from the same website ("owners") or from websites operated by other organizations ("third parties"). The management of information collected by third parties is governed by the relevant third party privacy policies, to which reference should be made. In order to ensure increased transparency and convenience, the different privacy policies’ website addresses and methods for managing third-party cookies are reported in the table below, as well as in the "Customize" section of the banner displayed upon logging on to the website.

Social media

The website could use certain third-party cookies called “pixels or beacons”, used by popular social media, such as Facebook, Twitter, LinkedIn, or YouTube, or other social networks on the web. These cookies allow third parties to collect data on the visits of users browsing UPMC websites and to interact with them directly on their favorite social media. UPMCI will not share any browsing information or user data acquired through its websites with social media and social services on the web, as only the respective external links to UPMCI websites are present.

Duration of cookies

Some cookies (session cookies) remain active only until the browser is closed or logout. Other cookies "survive" when the browser is closed and remain available on subsequent visits by the user. These are called persistent cookies, and their duration is set by the server upon their creation. In some cases a deadline is set, in other cases the duration is unlimited. With the exception of those cookies whose information is exclusively stored for technical purposes, UPMCI uses persistent cookies for technical and preference purposes.

However, by browsing websites pages, interactions with websites operated by third parties may occur which could create or modify persistent and profiling cookies.

Cookie management

The user can decide which cookies to accept or not using:

  • the banner displayed upon accessing the UPMCI website;
  • modifying the user’s preferences through the specific website section Cookies Policy;
  • in general, through the browser settings.

Specific setting can be defined for different websites and applications. In addition, the best browsers allow to define different settings for "owner" cookies and "third party" cookies. The browser’s options menu allows to manage and define whether to accept or remove certain types of cookies.

Warning: total or partial deactivation of technical cookies may compromise using the features of the website areas reserved to registered users. On the contrary, access to public content is also possible by completely disabling cookies. Disabling "third party" cookies does not affect navigability in any way.

Users who completely disable cookies in the browser may not be able to use all interactive functions.

Data disclosure and dissemination

Data collected through cookies may only be processed by duly authorized staff. Moreover, such data can be disclosed to third parties only if they are specifically appointed as data processors to perform certain services related to current relations (e.g. consultants, service providers, web agencies).

Data collected through own cookies will not be disclosed or passed on to third parties. Data collected through third-party cookies may be transferred outside the European Economic Area (EEA) for technical or statistical purposes. This is done exclusively in full compliance with Regulation (EU) 2016/679 ("General Data Protection Regulation" or "GDPR") for third countries recognized by the European Commission as providing specific guarantees of adequacy or protection of personal data by signing the Standard Contractual Clauses approved by the European Commission with Decision(EU) 2021/915 for the transfer of personal data from EU countries to non-EU countries.

Social Media Platform Information Note

Pursuant to art. 13 of Regulation (EU) 2016/679, in the privacy policy published at https://upmc.it/about/privacy, as data controller, UPMC Italy is required to inform all users accessing UPMCI websites that upon each access to social media used by UPMCI (e.g., Facebook, LinkedIn, YouTube) or other channels, both UPMCI and the social media provider are appointed data controllers of the statistical data, in compliance with Case C-210/16: Judgment of the Court of Justice of the European Union (CJEU) of 5 June 2018.

The tools provided by social media to display statistics (e.g., "Insights" for Facebook) show data in an anonymous and aggregated form. Despite being a joint data controller with the social media provider, the data controller appointed in the privacy information note has no way to trace the user’s details, as specified in the information available on the website of the social media provider (e.g. Facebook "Page Insights Controller Addendum").

Rights of the data subject

Pursuant to articles 15-22 of the GDPR, the user may exercise his or her rights with the data controller at any time, in particular the rights of access, rectification, integration and, where allowed, portability of the data provided, in addition to obtaining erasure, restriction, or opposition to the data processing for legitimate reasons, as well as opposing to the automated decision-making process, including profiling, by contacting the data controller to the above-mentioned address or emailing the DPO at dpo@upmc.it.

In order to ensure the protection of personal data of the data subject, additional information may be required to confirm the identity of the data subject, thus guaranteeing the right to access the information (or to exercise any of the other rights) only to individuals who have the right to receive such communications. This is another necessary safety measure for personal data protection.

The request for access to personal information (or to exercise one of the above rights) is free of charge. Nevertheless, if the request is clearly groundless or excessive, a reasonable fee could be charged considering the administrative costs incurred to provide the information, or refuse to satisfy the request in such circumstances.
